| dc.abstract.en | The aim of this article is to answer the question posed in the title – how much law is there in a glass of wine. The analysis focuses on intellectual property law regulations, with particular emphasis on industrial property law in both Polish and EU legal frameworks. The article addresses issues such as the potential protection of a wine recipe as a work of authorship, the legal protection of the name and packaging, as well as the specific conditions for protecting wine as a geographical indication and as a trade secret. |
| dc.abstract.pl | Artykuł ma na celu udzielenie odpowiedzi na pytanie zadane w tytule – ile prawa jest w kieliszku wina. Analizie poddane zostaną regulacje prawa własności intelektualnej ze szczególnym uwzględnieniem prawa własności przemysłowej w prawie polskim i unijnym. W artykule zostaną poruszone takie zagadnienia jak ewentualna możliwość ochrony receptury wina jako utworu, sposób ochrony nazwy i opakowania oraz szczególne uwarunkowania ochrony wina jako oznaczenia geograficznego i tajemnicy przedsiębiorstwa. |
