| dc.abstract.en | The subject of the article is the analysis of legal regulations governing the payment services market and the emerging directions in legislation. With the dynamically evolving payment services market, new legislative acts are emerging, presenting challenges to financial institutions. The payment services market offers a wide range of services; however, it is also a space where numerous cases of fraud and abuse occur. The article aims to draw attention to problematic issuing services involving the issuance of instruments and acquiring services, which entail the acceptance of payment instruments and the execution of payment transactions. The analysis addresses interpretational conflicts and legislative errors in Polish legislation concerning authentication and authorization concepts. Additionally, the author attempts to demonstrate the trend where the European Union prioritizes consumer interests to ensure transactional certainty in the payment market. Furthermore, the article negatively evaluates the excessive transfer of transaction responsibility onto banks. Moreover, the author underscores the importance of a future-proof policy and the creation of universal regulations concerning fraud in the payment market. The essence of consumer education in electronic transaction security and the role of supervisory institutions are highlighted as means to ensure the stability and integrity of the entire payment sector. |
| dc.abstract.pl | Przedmiotem artykułu jest analiza regulacji prawnych rynku usług płatniczych oraz kierunków tworzonych legislacji. W związku z dynamicznie rozwijającym się rynkiem usług płatniczych pojawiają się nowe akty prawne, które stawiają wyzwania instytucjom finansowym. Na rynku usług płatniczych istnieje szeroki katalog usług, jednak równocześnie jest to także przestrzeń, w której obecne są liczne przypadki oszustw i nadużyć. Artykuł ma na celu zwrócenie uwagi na problematyczne usługi issuingu polegające na wydawaniu instrumentów oraz usługi acquiringu która polega na możliwości akceptowania instrumentów płatniczych oraz wykonywania transakcji płatniczych. Analizowane są sprzeczności interpretacyjne i błędy legislacyjne w polskim ustawodawstwie, dotyczące pojęć uwierzytelniania i autoryzacji. Ponadto autorka podejmuje próbę wykazania tendencji, że Unia Europejska priorytetowo chroni interesy konsumentów w celu zapewnienia pewności transakcyjnej na rynku płatniczym. W dalszej części ocenia negatywnie przenoszenie nadmiernej odpowiedzialności dotyczące zapewnienia odpowiedzialności transakcji na banki. Dodatkowo autorka podkreśla znaczenie polityki future proofi tworzenia uniwersalnych regulacji dotyczących oszustw na rynku płatniczym. Istota edukacji konsumentów w zakresie bezpieczeństwa transakcji elektronicznych oraz roli instytucji nadzorczych została ujęta jako środek do zapewnienia stabilności i uczciwości funkcjonowania całego sektora płatności. |
