| dc.abstract.en | This article aims to show the knotty issues related to disciplinary penalties imposed on university teachers. The point of reference is first to define the subject matter of the disciplinary offense and then to describe the evolution of the system of disciplinary penalties and their extent and essence. The paper draws attention to the legislative shortcomings in the discussed areas and attempts to indicate amend-ments to the existing catalog of disciplinary penalties to ensure their enforceability and improve the effectiveness of the disciplinary procedure. The article also con-siders the directions of revision in the disciplinary penalties, taking into account both the solutions existing in the national laws regulating disciplinary responsi-bility and those found in the legal systems of other countries. |
| dc.abstract.pl | Przedmiotem artykułu jest ukazanie węzłowych zagadnień związanych z karami dyscyplinarnymi orzekanymi wobec nauczycieli akademickich. Punktem odniesienia stało się w pierwszej kolejności określenie strony przedmiotowej przewinienia dyscyplinarnego, a następnie ewolucji systemu kar dyscyplinarnych, a także ich wymiaru i istoty. W opracowaniu zwrócono uwagę na niedostatki legislacyjne w omawianych zakresach i podjęto próbę wskazania zmian w istniejącym katalogu kar dyscyplinarnych w celu zapewnienia ich wykonalności oraz poprawy efektywności procedury dyscyplinarnej. Artykuł zawiera również rozważania dotyczące kierunków rewizji w zakresie kar dyscyplinarnych z uwzględnieniem zarówno rozwiązań istniejących w krajowych ustawach regulujących odpowiedzialność dyscyplinarną, jak i tych, które występują w systemach prawnych innych państw. |
