dc.abstract.enThis study explores the evolution of concepts and practices concerning the use of armed force, situating them within the broader context of shifting geopolitical realities, technological change, and the emergence of new actors and new weapons (including humanitarian intervention, pre-emptive self-defence, preventive military operation, cyberattacks or hybrid warfare). Particular attention is devoted to the challenges posed by international terrorism, and to the proliferation of weapons of mass destruction. It analyses the key legal terms, including self-defence, armed attack, and the attribution of responsibility for the actions of non-state actors. The criteria of necessity and proportionality are assessed as well as the interplay between politics and law. The persistence of tension – between security and legality, legality and legitimacy, sovereignty and human rights, stability and change – underscores the need for renewed reflection on the limits and possibilities of regulating the use of force in the era of global politics. By engaging with both state practice and scholarly debate, this study argues that international law is undergoing a process of adaptation, though not without contradictions and risks.
