dc.abstract.enThe text presents issues related to the normative understanding of the subject of the right to defence, which is defined in a clearly different manner in national regulations. What distinguishes the code approach from the constitutional approach is a formal element based on a decision by a procedural authority in the form of a decision to present charges (Article 313 § 1 of the Code of Criminal Procedure) or to proceed with questioning as a suspect before issuing a decision to present charges (Article 308 § 2 of the Code of Criminal Procedure). The draft amendment to Article 71 § 1 of the Code of Criminal Procedure currently under consideration provides for the abandonment of this criterion, which is intended to harmonise the model of the right to defence with the standard set out in Article 42(2) of the Polish Constitution, but also with Article 2(1) of Directive 2013/48/EU of the European Parliament and of the Council, which, although it refers to the so-called ‘official notification […] by the competent authorities’ of a person’s status as a suspect, also provides for ‘another way’ of notifying them of this status.
dc.abstract.plW tekście przedstawiono problematykę związaną z normatywnym rozumieniem podmiotu prawa do obrony, który przepisy krajowe definiują w sposób wyraźnie odmienny. Tym, co różnicuje ujęcie kodeksowe od konstytucyjnego, jest element formalny, opierający się na decyzji organu procesowego przybierającej postać postanowienia o przedstawieniu zarzutów (art. 313 § 1 k.p.k.) lub przystąpienia do przesłuchania w charakterze podejrzanego przed wydaniem postanowienia o przedstawieniu zarzutów (art. 308 § 2 k.p.k.). Obecnie procedowany projekt nowelizacji art. 71 § 1 k.p.k. zakłada rezygnację z tego kryterium, co ma zharmonizować model prawa do obrony z wzorcem określonym przez art. 42 ust. 2 Konstytucji RP, ale też z art. 2 ust. 1 Dyrektywy Parlamentu Europejskiego i Rady 2013/48/UE, który choć odwołuje się do tzw. „oficjalnego powiadomienia […] przez właściwe organy” o postawieniu danej osoby w stan podejrzenia, to zarazem przewiduje także „inny sposób” awizowania jej tego stanu.
